1. INFORMATION FOR USERS
Who is responsible for processing your personal data?
Casa Naya Ibiza SL is the DATA CONTROLLER responsible for processing the USER's personal data and informs you that such data will be processed in accordance with Regulation (EU) 2016/679 of 27 April (GDPR) and Organic Law 3/2018 of 5 December on the Protection of Personal Data and Guarantee of Digital Rights (LOPDGDD).
Why do we process your personal data?
To maintain a commercial relationship with the user. The processing operations may include:
- Sending commercial and advertising communications by email, fax, SMS, MMS, social media or any other electronic or physical means, present or future, that makes commercial communications possible. These communications will be carried out by the DATA CONTROLLER and will relate to its products and services, or those of its collaborators or suppliers with whom it has entered into promotional agreements. In such cases, third parties will never have access to personal data.
- Conducting market research and statistical analyses.
- Processing orders, requests, responding to enquiries or any other type of request made by the USER through any of the contact methods made available on the DATA CONTROLLER's website.
- Sending online newsletters regarding news, offers and promotions related to our activities.
What is the legal basis for processing your personal data?
The processing of your personal data is based on Article 6 of the GDPR as follows:
- With the USER's consent: sending commercial communications and newsletters.
- Based on the DATA CONTROLLER's legitimate interest: conducting market research, statistical analyses, processing orders, requests, and responding to enquiries made by the USER.
How long do we keep your personal data?
Personal data will be retained no longer than necessary to fulfil the purpose of the processing or for as long as required by applicable legal obligations. Once the data is no longer necessary, it will be deleted using appropriate security measures to ensure anonymisation or complete destruction.
Personal data will be retained for the legally established period, currently three (3) years.
Who do we share your personal data with?
No personal data will be disclosed to third parties unless required by law or when necessary for the provision of the service.
In particular, and in accordance with current Spanish regulations on public safety and guest registration, Casa Naya Ibiza SL may communicate certain personal data of guests to the competent authorities through the official SES Hospedajes platform of the Ministry of the Interior, when required by applicable legislation.
Likewise, data may be disclosed to service providers acting as data processors, with whom the DATA CONTROLLER has signed the corresponding confidentiality and data processing agreements in accordance with current data protection regulations.
What are your rights?
The USER has the following rights:
- The right to withdraw consent at any time.
- The right of access, rectification, portability and erasure of personal data, and the right to restrict or object to its processing.
- The right to lodge a complaint with the supervisory authority (www.aepd.es) if you believe that the processing does not comply with current regulations.

2. MANDATORY OR OPTIONAL NATURE OF THE INFORMATION PROVIDED BY THE USER
By checking the relevant boxes and entering data in fields marked with an asterisk (*) in contact forms or download forms, USERS expressly, freely and unequivocally accept that their data is necessary to process their request. The inclusion of data in the remaining fields is voluntary.
The USER guarantees that the personal data provided to the DATA CONTROLLER is accurate and undertakes to communicate any changes thereto.
The DATA CONTROLLER informs users that all data requested through the website is mandatory, as it is necessary to provide an optimal service to the USER. If all required data is not provided, it cannot be guaranteed that the information and services offered will fully meet the user's needs.
3. SECURITY MEASURES
In accordance with current data protection regulations, the DATA CONTROLLER complies with all provisions of the GDPR and the LOPDGDD regarding the processing of personal data under its responsibility, and expressly with the principles described in Article 5 of the GDPR, according to which personal data is processed lawfully, fairly and transparently in relation to the data subject, and is adequate, relevant and limited to what is necessary in relation to the purposes for which it is processed.
The DATA CONTROLLER guarantees that it has implemented appropriate technical and organisational policies and measures to apply the security standards required by the GDPR and the LOPDGDD in order to protect the rights and freedoms of USERS, and has provided them with the necessary information to enable them to exercise those rights.
